The New USG Copyright Policy, and Using Copyrighted Works: What Is and Isn’t Considered Fair Use

SUMMARY

The correct application of Fair Use in the college and university setting is often confusing and difficult to determine. In order to avoid having to pay statutory damages or worse, it is critical that everyone who is using copyrighted works for educational purposes knows exactly what they can and can’t use.

SPEAKERS

Kevin Smith is the Scholarly Communications Officer at Duke University. He holds a Masters of Library Science from Kent State University and a law degree from Capital University. He is admitted to the bar in Ohio and North Carolina. Kevin serves on Duke University’s Intellectual Property Board, the American Library Association’s Committee on Legislation Subcommittee on Intellectual Property and on the faculty of the Association of Research Libraries’ Institute on Scholarly Communications.

Lee Davis is Associate Vice President for Legal Affairs, Georgia Southern University.

Bede Mitchell is Dean of the Zach S. Henderson Library, Georgia Southern University

Know Your Copy Rights

As we recently announced, the University System of Georgia has a new copyright policy, effective immediately, that will directly affect all of us.  Along with reading the new policy, we also strongly recommend that you become familiar with this handy 6-page brochure, “Know Your Copy Rights,” from the Association of Research Libraries, as well as this copyright guide from Georgia Southern University’s Office of Legal Affairs.

New USG Copyright Policy

We strongly recommend that you read the new copyright policy adopted by the University System of Georgia.  Included are important statements on your rights and responsibilities regarding copyright, and please notice the links on the left side of the page, which point to details on the new policy–  in particular the fair use checklist and the guidelines for electronic reserves.  We all must become familiar with this new policy, so please pass it on!
